By accessing the Site or purchasing from us you agree to these Terms.

2. Eligibility

You must be at least the age of majority in your country/region to purchase. You agree not to use the Site for unlawful purposes.

3. Prices, currency & VAT

Prices are shown in Euro (EUR) and, where applicable, include VAT at the rate in force at the time of ordering. Shipping charges and any optional services are shown at checkout. If you select a non-standard/express delivery, the surcharge is your responsibility.

4. Contract formation

Your order is an offer to buy. The contract is formed when you receive our order confirmation email. We may reject or cancel an order (e.g., suspected fraud, stock unavailability, pricing error). If we cancel after payment, we’ll refund you in full.

5. Delivery, risk & title

We deliver to the countries shown at checkout. Delivery dates are estimates. Risk in the goods passes to you upon delivery; title passes when we receive full payment.

6. Right of withdrawal (EU 14-day cooling-off)

If you are an EU/EEA consumer, you have the right to withdraw from your purchase within 14 days from delivery without giving any reason.
To exercise this right, email support@cosmerna.com with your order number and a clear withdrawal statement within 14 days. You must return the goods within a further 14 days.

  • Return costs: You are responsible for the costs of returning the goods, as well as the original delivery cost, except where the goods are faulty or incorrectly supplied.

  • Refund: We will refund only the product price, excluding both the original delivery fee and any return shipping costs, unless the return is due to a defect or our error.

Hygiene exception: For health protection and hygiene reasons, cosmetics that have been opened or whose seal is broken are not eligible for withdrawal unless they are faulty.

7. Returns for faults (legal guarantee)

If an item is defective, damaged or not as described, contact us immediately at support@cosmerna.com. EU consumers benefit from a 2-year legal guarantee. Where applicable, we will repair, replace, or refund (including return shipping at our cost).

Items sent back without prior request may be refused.

9. Refund timing

Once we receive and inspect the return, we’ll notify you. Approved refunds are issued to the original payment method within 14 days of your withdrawal notice (we may wait until we receive the goods or proof of return). Your bank/card issuer may take additional time to post the refund.

10. Product information & limitations

We try to display colours and images accurately but cannot guarantee that your device’s display of any colour will be exact. We may limit sales by person or region, limit quantities, or discontinue products. All offers are void where prohibited.

11. Promotions & discount codes

Promotions are subject to their own terms and may not be combined unless stated. Discount codes must be applied at checkout and cannot be exchanged for cash or applied retroactively.

12. Prohibited uses

You must not misuse the Site (e.g., introduce viruses, attempt unauthorized access, mine data, infringe IP rights, harass or discriminate). We may suspend or terminate access for violations.

13. Intellectual property

All content on the Site (text, graphics, logos, images, software) is owned by or licensed to us and is protected by IP laws. You may not use our trademarks without permission.

14. Liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable law.

To the extent permitted by law, we are not liable for:

  • loss not caused by our breach;

  • any business losses (including loss of profit, revenue, data or goodwill) where you purchase as a consumer;

  • delay or failure due to events beyond our reasonable control (force majeure).

Our total liability for any loss arising from a consumer contract is limited to the amount you paid for the product(s) giving rise to the claim.

15. Privacy

Your personal data is processed in accordance with our Privacy Policy (see Site footer). We share certain data with our EU distributor/representative (Bioneer Biotech GmbH) to fulfil EU orders and support; see the Privacy Policy for details.

EU consumers may also use the European Commission Online Dispute Resolution (ODR) platform.

17. Governing law & jurisdiction

These Terms are governed by the laws of Germany. You may bring legal proceedings in the competent courts of your place of residence or in Germany. Mandatory consumer protection laws of your country of residence will apply in addition to or instead of German law where required.
We do not require arbitration for EU consumers.

18. Changes to these Terms

We may update these Terms from time to time. The version posted on the Site at the time of your order applies to that order.
